Mr. Murphy provides comprehensive counsel to developers, builders and contractors on all aspects of development and construction, from entity formation, land acquisition, entitlements and permitting through contract negotiation and dispute resolution.
Mr. Murphy has handled complex litigation and trials in state and federal courts, as well as appeals to the Washington State Courts of Appeals, the Washington State Supreme Court and the Ninth Circuit Court of Appeals. His practice includes all forms of dispute resolution, including arbitration and mediation. He has extensive experience handling land use and other administrative hearings, including numerous Land Use Petition Act hearings and appeals.
Some of the projects and disputes that he has been involved in include: permitting, approvals and dispute resolution for one of Washington State's largest master planned communities; entitlement hearings land use appeals for numerous large plats and planned unit developments in counties throughout Washington; entitlement hearings and land use appeals for large lot recreational land development in Kittitas County; contract negotiation, comprehensive plan amendments, rezones and appeals relating gravel pit operations; Growth Management Act appeals; negotiation of development agreements for mixed use, commercial and residential projects; litigation of claims relating to major public utility projects; litigation of claims relating to hospital and school projects; litigation of claims against governmental entities for permit denials; prosecution of delay, impact and equipment damage claims relating to a bridge seismic retrofit project in California; litigation of contract disputes between owners and contractors relating to site improvements; litigation of construction defect claims; litigation of easement and boundary disputes; litigation of insurance coverage claims relating to pollution clean up; and litigation of condemnation claims for state, county and municipal projects.
Mr. Murphy's experience in real estate, land use and construction makes him uniquely suited to understand the full range of issues affecting development and construction projects and to assist his clients in achieving their business objectives.
