Mr. Carmalt's practice is focused primarily upon land use and construction disputes. He represents general contractors for public and private construction projects in disputes with owners and subcontractors. Mr. Carmalt also assists developers with regulatory disputes involving denial of permits, preliminary or final plat approval, and SEPA threshold determinations.
Mr. Carmalt assists companies at all stages of disputes, from pre-litigation dispute resolution through appeals. He has dealt with a wide variety of legal issues, including the construction statute of repose, constructive acceleration, material shortages, cumulative impact claims, defective specifications and plans, changed conditions, prevailing wage violations, bid protests, breach of contract, negligent misrepresentation, and successor liability. He has worked on matters involving numerous different public and private construction projects, including the Sound Transit Central Link Light Rail Project, Safeco Field, Washington Square, the Portland Harbor Superfund Clean-up, the Columbia Business Center, the Green River Water Treatment Plant, and numerous road way, commercial, and planned urban development projects.
